Proposed - Public Space Protection Orders
11 September 2017
FROM SOUTH NORFOLK DISTRICT COUNCIL
I am writing to advise you that we are starting a consultation process on a proposal to make a Public Space Protection Order (PSPO) and as part of this process we would welcome your input. If there are any other organisations bodies etc. who you feel we should consult directly e.g. organisations owning play areas, local dog clubs, etc. I would welcome your input as we wish to be inclusive.
Our existing Dog Control Order that requires the person in control of a dog to clean up after it will be repealed in October. It is therefore proposed that we make a PSPO to requires a person to clean up after their dog following this date.
In addition, having regard to residents’ concerns, we also intend the PSPO to also exclude dogs from enclosed children’s play areas (i.e. those enclosed by a fence) in South Norfolk that are open to the air.
A PSPO is a measure, introduced by the Anti-Social Behaviour, Crime and Policing Act 2014, that replaces some existing legislation we can use, and introduces wider discretionary powers, to deal with any particular nuisance or problem that is detrimental to the local community’s quality of life. They seek to ensure that the law-abiding majority can use and enjoy public spaces, safe from anti-social behaviour. The Orders can be enforced by fixed penalty notices or by prosecution.
You can view the consultation and further information here: Consultation.
